How an Appeals Court Just Changed the Game for Sports Betting States!

Date:

6th Circuit Rules States Can Regulate Sports Event Contracts, Defeating Kalshi

⚡ Quick Read (30-Sec Summary):

  • The 6th U.S. Circuit Court of Appeals ruled that states can regulate sports event contracts, a setback for prediction market platforms.
  • Ohio and Tennessee can apply their gambling laws to Kalshi’s contracts, which were contested under federal jurisdiction claims.
  • This ruling follows similar decisions from other circuit courts, leading to a potential U.S. Supreme Court review.

On Friday, the 6th U.S. Circuit Court of Appeals issued a ruling affirming the rights of states to regulate sports-related event contracts on prediction market platforms, representing a significant defeat for the industry as it prepares for potential escalation to the U.S. Supreme Court.

The unanimous decision by the three-judge panel concluded that Ohio and Tennessee are authorized to enforce their state gambling laws on contracts offered by Kalshi, a prominent prediction market platform.

According to the court’s opinion, “We hold that Kalshi has not shown that its sports-event contracts satisfy the statutory definition of a ‘swap’ so as to fall within the scope of the CFTC’s ‘exclusive jurisdiction,'” addressing the contention between state laws and federal regulatory claims.

Kalshi, alongside other prediction market platforms, maintains that all event contracts should be classified as swaps, a financial derivative governed by the Commodity Futures Trading Commission (CFTC). However, state authorities contend these contracts qualify as gambling, hence should adhere to state sports betting regulations.

The conflicting interpretations have initiated a nationwide legal dispute, with states suing platforms for purported illegal gambling activities while those platforms seek to challenge state laws, advocating for federal regulation of their offerings.

The CFTC has intervened on this matter by suing nine states to assert its claimed exclusive authority to regulate event contracts under the Commodity Exchange Act. Nevertheless, the 6th Circuit panel rejected this premise.

The court added, “Even assuming that Kalshi’s sports-event contracts are swaps, we alternatively hold that the CEA neither expressly nor impliedly preempts Ohio’s or Tennessee’s gambling laws.” This ruling overturned a previous federal district court decision in Tennessee favoring Kalshi and upheld a ruling from a federal district court in Ohio that aligned with state perspectives.

Jonathan Skrmetti, Tennessee’s attorney general, remarked, “Kalshi attempted an end run around Tennessee law to avoid any of the rules or taxes associated with sports gambling. They failed.” He asserted the importance of stringent regulations in sports wagering for public safety.

Requests for comments from Kalshi and the CFTC went unanswered. CNBC has also contacted the Ohio attorney general’s office for further statements.

The recent court ruling marks the second setback for prediction market platforms at the appeals court level. Last month, the 9th U.S. Circuit Court of Appeals ruled that Nevada has the authority to regulate sports-related event contracts, classifying them as sports bets. Earlier in April, the 3rd U.S. Circuit Court of Appeals ruled against New Jersey, establishing that the CFTC holds exclusive regulatory rights over swaps, irrespective of contract type.

In response to this, New Jersey has filed a petition to the Supreme Court, although it remains uncertain when the Supreme Court will address the case or if it will await further circuit court decisions regarding sports-related event contracts.

Disclosure: CNBC and Kalshi have a commercial relationship that includes customer acquisition and a minority investment.
