Federal prosecutors in Atlanta have brought an obstruction charge against Samuel Tunick, a U.S. citizen, after he handed customs officers a duress passcode that triggered software to erase his phone’s contents. Authorities detained and interrogated Tunick at Hartsfield-Jackson Atlanta International Airport on Jan. 24 of last year as he returned from a vacation in the Dominican Republic, subsequently seizing the device before permitting him to enter the country. The prosecution marks one of the earliest known federal instances of charging an individual with destroying evidence via a specialized device-wiping program.
The Statute and Legal Framework Behind the Obstruction Charge
The underlying federal statute makes it a felony carrying up to five years in prison, a fine, or both to destroy evidence, transfer assets to evade government seizure, or tip off targets about upcoming searches or wiretaps. Legal experts note that the act applies before, during, or after a search if an individual acts to thwart an imminent search or seizure. Within the legal system, courts treat digital data as property—akin to intellectual property theft—meaning a software wipe is prosecuted no differently than flushing physical evidence. Prosecutors argue that the physical phone served merely as a container for the data, which they possessed the lawful authority to seize.
Defense Arguments and the Controversy of Border Searches
During a federal court hearing in Atlanta, defense lawyers argued that the seizure was unlawful and that Tunick was targeted due to his political activism opposing “Cop City,” Atlanta’s planned police and fire training center within a 1,000-acre urban woodland. The border search remains central to both sides; customs authorities assert the right to search and seize incoming digital devices without a warrant because travelers are not officially on U.S. soil until authorized to enter. Conversely, the defense contends that Tunick experienced unlawful detention, was never read his rights, and faced repeated denials of requests to speak with legal counsel.
Mechanics of GrapheneOS Duress Passcodes and Legal Intent
Tunick utilized GrapheneOS, a private open-source mobile operating system compatible with select Android phones that features a secondary duress passcode. Entering this specific code prompts the operating system to execute a full wipe of digital contents while leaving the physical hardware intact. Columbia University law professor Daniel Richman explained that while a traveler deleting files prior to an airport checkpoint to protect personal privacy may not display criminal intent, intentionally inputting a wipe code while actively being questioned by authorities places an individual squarely within the scope of the obstruction statute.
