Binance Alters Law Enforcement Cooperation, Frustrating Global Investigators
Binance, the world’s largest cryptocurrency exchange, has altered its procedures for cooperating with law enforcement agencies globally, creating hurdles for investigators tracking scammers and combating money laundering. The policy change requires officials to route certain inquiries through foreign government agencies via time-consuming international treaties. While the company maintains that the adjustments ensure adherence to regulations and privacy laws regarding personal data, investigators note the new rules have introduced significant obstacles to fighting financial crime.
Stymied Investigations and Slowed Response Times in Europe
The policy changes have caused severe delays for European investigators trying to trace cross-border transactions and freeze fraudulent accounts. Police officers from five European countries attending a conference in the Netherlands reported widespread difficulties obtaining information from Binance, outside of extreme cases involving child sexual abuse material, terrorism, or imminent threats to life. Most inquiries are now channeled through the United Arab Emirates government—where Binance is regulated and secured a license in Abu Dhabi—dramatically reducing response speeds. Law enforcement officials have voiced concerns over potential conflicts of interest, noting that the Emirati investment firm MGX is funded by Abu Dhabi royals.
U.S. Scrutiny and the Impact on Fast-Moving Financial Investigations
Although U.S. law enforcement remains largely exempt from routing requests through foreign governments, Binance has occasionally instructed state prosecutors to utilize international channels, hindering at least two domestic investigations. Alona Katz, an assistant district attorney in Brooklyn, emphasized that operational speed is vital in fast-moving financial crimes where criminals transfer funds between accounts within minutes or seconds. While noting that Binance is often responsive domestically, Katz highlighted that obtaining records for users based in the United Arab Emirates remains problematic. Manhattan District Attorney Alvin Bragg also stressed the necessity of timely cooperation from major, highly profitable cryptocurrency corporations for the sake of theft victims.
Regulatory Shifts, Plea Deals, and Compliance Staff Turnover
The policy shift coincides with broader political and organizational changes, including a friendlier approach toward the crypto industry by the Trump administration, which eased federal scrutiny and established business ties between the president’s family start-up, World Liberty Financial, and Binance. Concurrently, Binance navigated internal turmoil following the departure or suspension of several senior compliance employees late last year, leading to confusion regarding law enforcement requests. The exchange previously paid $4.3 billion in penalties and pleaded guilty in 2023 to compliance violations under a plea deal requiring heightened vigilance against financial crime, after which billionaire founder Changpeng Zhao spent four months in federal prison before receiving a presidential pardon.
